This Policy explains how the registered ownership of a genuine Redkey data-erasure device, its associated software licence and any remaining commercial warranty or support eligibility can be transferred to another owner.
It forms part of our Terms of Service, End User Licence Agreement and Warranty, Returns and Refunds Policy. Mandatory rights under applicable law are not affected.
1. Scope and definitions
In this Policy:
- Registered Owner means the person or organisation recorded by Redkey USB Ltd as the current owner of a Redkey Device;
- New Owner means the person or organisation to whom the Redkey Device and its associated Licence are to be transferred;
- Redkey Device means a genuine Redkey data-erasure USB device carrying a valid, unaltered Redkey serial number, whether working or non-working, unless it is ineligible under section 3;
- Licence means the right to use the Redkey software associated with that specific Redkey Device; and
- Business Day means Monday to Friday, excluding public holidays in England and Wales.
This process applies to Redkey Devices, including an eligible device acquired indirectly or through an authorised reseller. It does not apply to a Licence separately from its Redkey Device, ordinary accessories, stickers, packaging or the permanently non-functional Redkey Physical Fit Model. Those items remain subject to any consumer or contractual rights that otherwise apply.
2. What transfers
When we approve and record a transfer, the following move together to the New Owner:
- registered ownership of the Redkey Device;
- the Licence associated with that Redkey Device;
- any unexpired part of the applicable commercial warranty; and
- any remaining eligibility for limited extended support attached to the Redkey Device.
The physical Redkey Device and its Licence cannot be separated, duplicated or transferred to different people. A Licence cannot be sold, assigned or transferred by itself.
A transfer does not restart, renew or extend a warranty or support period. The New Owner receives only the remaining period and must comply with the Terms of Service, End User Licence Agreement and product policies that apply when they use the Redkey Device. An eligible Redkey Device may be transferred more than once, but each transfer must be approved and recorded separately.
The parties decide between themselves when legal ownership of the physical device passes. Our confirmation records the owner and licensee in Redkey USB Ltd’s systems; it is not a guarantee that a private sale, gift or other transaction between the parties is valid.
3. Eligibility
A transfer may be approved where:
- the product is a genuine Redkey Device with a valid, unaltered serial number;
- the Registered Owner, or a person authorised to act for them, starts the request;
- ownership and authority can be reasonably verified;
- the proposed transfer is lawful;
- the information provided is materially complete and accurate; and
- the device has not been reported lost, stolen, fraudulently obtained or subject to a conflicting ownership claim.
An indirect purchase, purchase through an authorised reseller, procurement route, company reorganisation, estate administration or gift is not automatically ineligible. We may require proportionate additional evidence to establish the ownership chain or the requester’s authority.
4. Starting a transfer
The Registered Owner, or a person authorised to act for them, must use the form at https://redkeyusb.com/pages/warranty-transfer. One request may include more than one Redkey Device where the form permits this.
The request should include:
- the Redkey serial number or numbers;
- the current registered name, organisation and email address, where applicable;
- the New Owner’s name, organisation and email address;
- the original order or backer reference, if known;
- how the Redkey Device was obtained;
- an explanation or evidence of authority where the requester acts for an organisation, an estate or another person; and
- any purchase, transfer or identity evidence reasonably requested by us.
Do not publish a serial number or disclose it to anyone who does not need it.
The standard process does not use or require a transfer code. If an older transfer code was previously issued, contact us rather than publishing or reusing it.
5. Verification and acceptance
After receiving a request, we may:
- check the serial number, purchase, activation and registration records;
- contact the Registered Owner, New Owner, relevant organisation or procurement intermediary;
- ask for additional evidence of ownership or authority;
- check for conflicting, lost, stolen, counterfeit, altered or fraudulent-device reports; and
- require the New Owner to accept the terms that apply to the Licence.
We will request only information that is reasonably relevant to the transfer and security checks. If information is missing, we may ask for a reasonable alternative rather than insisting on a single form of proof where another reliable form is available.
6. Decision and completion
Submitting the form or physically handing over the device does not update our records. The transfer becomes effective in our systems only when Redkey USB Ltd confirms approval.
When the transfer is confirmed:
- the New Owner becomes the registered owner and licensee for the Redkey Device;
- the New Owner may use any remaining commercial warranty and eligible support attached to it;
- the former Registered Owner must stop using or representing the Licence as theirs;
- the former Registered Owner no longer has warranty or support rights for that Redkey Device; and
- future product-specific communications may be sent to the New Owner.
We may confirm the outcome to both parties where appropriate. If a request is refused or paused, we will normally explain the main reason unless doing so would compromise fraud prevention, security or another person’s rights.
7. Grounds for pausing or refusing a request
We may pause or refuse a transfer where:
- ownership or authority cannot be reasonably verified;
- information is materially incomplete, inconsistent or inaccurate;
- the serial number is invalid, removed, altered or does not match the device;
- the device is counterfeit, reported lost or stolen, or subject to a credible competing claim;
- fraud, unlawful activity or a security threat is reasonably suspected;
- the proposed transfer would breach applicable law; or
- there is a material breach directly connected with the device, Licence or proposed transfer.
We will not refuse a transfer merely because the Registered Owner has made an unrelated complaint or exercised a statutory right.
If ownership is disputed, we may restrict changes to the registration record while reasonable evidence is obtained. We do not decide private property disputes and may require the parties to resolve them through an appropriate legal process.
8. Private sales, delivery and condition
Redkey USB Ltd is not a party to a private sale, gift, shipment or payment arrangement between the parties. We do not verify the price, physical condition, provenance or statements made by either party, except to the extent needed for our registration and security checks.
The parties are responsible for their own payment, delivery, insurance, tax, customs and import arrangements. Do not send a device to Redkey USB Ltd unless we have first approved a return and provided the correct instructions and address.
The Registered Owner is responsible for supplying the correct device. The New Owner should check its condition and remaining warranty or support status before acquiring it.
9. Warranty and support after transfer
An approved transfer does not create a new warranty. Any unexpired commercial warranty remains governed by the Warranty, Returns and Refunds Policy and runs from its original applicable start date.
Eligible limited extended support may transfer with the device, but it is not a ten-year warranty and does not guarantee free repair or replacement. Product condition, exclusions, evidence requirements and any agreed charges continue to apply.
Repair or replacement of a transferred device remains subject to the applicable policy and mandatory consumer law. A transfer does not make Redkey USB Ltd responsible for damage, loss, alterations or misrepresentations arising from a private sale or shipment between the parties.
10. Email-address changes without a transfer
A Registered Owner may use the same form to request an update to the email address associated with a Redkey Device without changing ownership.
We will verify the requester’s identity or authority before changing the record. An email-address change does not transfer the device or Licence and does not restart any warranty or support period.
11. Processing time and fees
We do not charge a standard administration fee for a normal ownership transfer or registered-email update.
We aim to respond within three Business Days after receiving a complete request. More time may be needed for indirect purchases, organisations, estates, disputed ownership, missing information or security checks. This is a service target, not a guaranteed deadline.
We will explain and obtain agreement to any separate charge before it is incurred. The parties remain responsible for their own shipping, tax, customs and professional costs.
12. Personal data
We use transfer information to verify identity and authority, prevent fraud, update ownership and licence records, and administer warranty and support. More information is in our Privacy and Data Protection Policy.
Information supplied by one party may be checked with the other where reasonably necessary. We will not disclose unnecessary account, order or personal information.
13. Liability, mandatory rights and governing terms
Nothing in this Policy limits liability that cannot lawfully be limited or excludes mandatory consumer rights.
The limitations of liability, governing law, jurisdiction and dispute provisions in our Terms of Service apply to this Policy. If this Policy conflicts with the End User Licence Agreement on the mechanics or effect of an ownership transfer, this Policy takes priority for that issue. The Warranty, Returns and Refunds Policy takes priority on warranty, return and remedy issues.
14. Changes and contact
We may update this Policy when our process, law or product range changes. The current version and effective date are published on our website. A completed transfer or accrued right is not retrospectively undone by a later policy change.
